The VR experience called “The First FIFA World Cup™” (hereinafter referred to as the “App”) was developed by NMY Mixed-Reality Communication GmbH, Hanauer Landstraße 188, 60314 Frankfurt am Main, Germany, email: info(at)nmy.de, Tel. +49-69-150 44 88 60 (hereinafter “NMY,” “we,” or “us”) on behalf of FIFA Museum AG, Seestrasse 27, CH-8002 Zurich, Switzerland (hereinafter “FIFA Museum” or “Publisher”), and provided by the Publisher.
1.2. Purpose and Objective of the App
The App takes users on a virtual journey back to 1930, narrating the real journey of European football teams from Villefranche-sur-Mer to the first FIFA World Cup in Uruguay. During this journey, users get to know key figures, artifacts, and events of this historical moment and can interact with characters and objects.
1.3. Collection and Processing of Personal Data When Using the App
We do not collect or process any personal data about you when you use the App. Personal data is defined as any information relating to an identified or identifiable natural person. However, as your privacy is important to us, we would like to inform you that personal data about third parties is processed, which we have no control over.
2. General Information on the Processing of Your Data
2.1. Information Collected During the Download
When you download the application, information is automatically transmitted to the respective store offering the application. This includes data such as your username, email address, account customer number, download time, payment information, and your device’s unique identifier. The terms of use, privacy policies, and legal information of the respective stores can be found at the following links. You have already agreed to these terms by using your device.

2.2. Additional Automatically Collected Data
During the use of the application, certain data required for its use is automatically collected. This includes data such as device ID, headset language settings, operating system version, and access time. This data is automatically processed within the application to provide you with the service and its associated functions. This data processing is justified by the fact that (1) the processing is necessary for the performance of the contract between you as the data subject and us, according to Art. 6 para. 1 lit. b GDPR, for the use of the application, or (2) we have a legitimate interest in ensuring the functionality and error-free operation of the application and offering a market-appropriate and user-relevant service, which outweighs your rights and interests in the protection of your personal data according to Art. 6 para. 1 lit. f GDPR.
3. General Rights as a Data Subject Under the GDPR
3.1 As mentioned in section 1.3, no personal data is collected or processed by us as the developer of the application when using the App. For purely informational purposes, we would still like to inform you about your general rights under the GDPR:
3.2 Right to Access: You have the right to request information at any time about the personal data we process about you, as stipulated in Art. 15 GDPR.
3.3 Right to Rectification of Incorrect Data: You have the right to request the immediate correction of any inaccurate personal data concerning you.
3.4 Right to Erasure: You have the right to request the deletion of your personal data under the conditions described in Art. 17 GDPR. These conditions particularly include the right to deletion if the personal data is no longer necessary for the purposes for which it was collected or otherwise processed, in cases of unlawful processing, the existence of an objection, or the presence of a deletion obligation under Union law or the law of the Member State to which the provider is subject.
3.5 Right to Restriction of Processing: You have the right to request the restriction of processing according to Art. 18 GDPR. This right exists particularly when the accuracy of the personal data is disputed between the user and the provider, for the period necessary to verify the accuracy, as well as in cases where the user, despite an existing right to deletion, requests restricted processing instead of deletion; furthermore, in cases where the data is no longer required for the purposes pursued by the provider, but the user needs it for asserting, exercising, or defending legal claims, and when the successful exercise of an objection between the provider and the user is still disputed.
3.6 Right to Data Portability: You have the right to receive the personal data concerning you that you have provided to a provider in a structured, commonly used, machine-readable format, as per Art. 20 GDPR.
3.7 Right to Object You have the right to object, at any time, on grounds relating to your particular situation, to the processing of personal data concerning you, which is based, inter alia, on Art. 6 para. 1 lit. e or lit. f GDPR, in accordance with Art. 21 GDPR.
3.8 Right to Lodge a Complaint You also have the right to lodge a complaint with a supervisory authority.
